Is Legal Separation Right for You?

What’s a “Legal Separation?”

No two separations are the same, but legally every separation falls into one of two categories. The first is simply being separated, and the second involves a formal Decree of Legal Separation. The actual date that you ‘separate’ will affect the potential divorce process, specifically with regard to property division. If marital assets change in the period since the date of separation, division may be drastically altered as a result.

“Moving out” doesn’t always count as being legally separated, and we highly suggest you contact us if you’re in such a situation. The legal legitimacy of the separation can be used to determine the living arrangements and agreements while you’re apart. It can help determine support obligations and co-parenting requirements. Finally, being separated allows you to be open to the possibility of either reconciliation or dissolution.
