California’s family court system is not perfect. In fact, errors in civil cases involving family issues such as divorce, child custody, and visitation occur more than often than most people think, resulting in unfair and incorrect judgments. If you believe you have been handed an unjust verdict, or if you have reason to believe an attempt may be made to overturn your hard-fought family court victory, contact Holstrom, Block & Parke, APLC today. Our skilled Newport Beach appellate attorneys can provide the trial-tested support you need to guard your interests and maximize your chances of securing a favorable outcome. We have experience handling appeals in most of the appellate courts in Southern California, in Northern California and in federal court (9th and 6th circuits).

While the appeals process can sometimes result in a reversal of a lower court’s decision, not all cases are subject to “appeal,” which is a technical term. Family court judgments cannot be appealed simply because one of the involved parties disagrees with the court’s decision; there must have been some sort of legal error in the application of the law in order for an appeal to be valid. Egregious abuses of court discretion, mishandling of evidence, failures to make adequate findings of fact, or the failure of the court to hold a plenary hearing (which are held when the judge is considering a motion by one of the parties that requires a court order before or after the conclusion of the divorce) are just some of the circumstances in which an appeal may be warranted. Given the vast amount of research, preparation and analysis involved in appellate cases, having a skilled legal advocate by your side can often be the deciding factor between success and failure.
You have limited time in which to file an appeal, so it is important to consult an experienced family law appellate attorney as soon as possible, so you don’t lose your opportunity to file an appeal in your matter.
Some orders are not appealable, but that does not mean you cannot have the appellate court review them. Often, particularly in situations where time is of the essence, you can file an emergency “writ” with the appellate court, seeking immediate relief. We have experience in a wide range of civil and family law writs, and we can help you determine if emergency writ relief would be appropriate for you.
Our team is fully equipped to take on all varieties of family-related appellate cases, including:
